Recent Amendments to Data Transfer Abroad Provisions of Turkish Personal Data Protection Law:
Where Does Türkiye Stand in GDPR Compliance?
About the Speaker:
Assoc. Prof. Dr. Nafiye Yücedag is a faculty member at Istanbul University Faculty of Law, Department of Civil Law, since 2011. She specializes in civil law, law of obligations, personal data protection law, and consumer law. Dr. Yücedag graduated from the Ankara University Faculty of Law and subsequently obtained a Master’s degree in European and International Law from Amsterdam University. In October 2015, she was awarded a PhD in Law from Istanbul University for her thesis on “The Buyer's Right to Replacement in Case of Non-Conforming Delivery of Goods under the Turkish Code of Obligations and the CISG”. Her postdoctoral research was particularly focused on personal data protection law. She is one of the authors of a multi-authored textbook on Personal Data Protection Law as well as two additional books. Dr. Yücedag has also published articles in numerous peer-reviewed journals and also presented papers at both national and international conferences.
About the topic:
The amendments to the Turkish Personal Data Protection Law (TPDL), which came to force on June 1, 2024, address the regulation of sensitive data and the transfer of personal data abroad. The amendments with regard to the transfer of personal data abroad seek to reinforce the protection of individuals whose personal data is transferred abroad. This is achieved by moving away from the previous approach, which prioritised “explicit consent,” and thus permitted data transfers without the requisite safeguards. The new framework seeks to establish mechanisms that strengthen the protection of personal data during cross-border transfers, in alignment with the General Data Protection Regulation (GDPR). The extent to which these amendments align with GDPR standards will be assessed, particularly in the light of the ongoing discussions surrounding data transfers between the EU and the US, as highlighted by the Court of Justice of the European Union’s rulings, most notably in the Schrems II decision.

The seminar series “Current Research on Turkish Law” regularly invites outstanding scholars and practitioners working on different topics of Turkish private law to present and discuss their findings. The seminar series particularly aims to create a platform where both international researchers interested in Turkish law and Turkish researchers working on comparative law can come together and exchange scholarly ideas. Participation is open to all interested students and researchers.
